IS THIS BILLED TO THE STATE?

Answer the questions and find out if you bill the transcript to the State.  There's always exceptions to the rules when you have a strange request, so contact us if you do not get the answer you think is correct.

Is the transcript for the case file for one of these purposes?

  • Waiver of counsel

  • Sentencing hearing for violent crime/DUI with bodily injury

  • Guilty plea or change of plea?

Explanation:  There are certain statutes and rules directing when a transcript is added to the case file to be made a part of the common law record. In these cases, indigency is not a factor, but it does need to be court ordered. 

Do you have a court order directing the transcript be filed in the case, and the Illinois statute or rule which authorizes it?

Explanation:  This is a very specific court order which needs to cite the statute or rule which allows for the State to pay for it.  The transcript must be ordered to be placed in the case file to be made a part of the common law record.
